WHO ARE WE?

Foundation is committed to protect your Personal Information and will be the data controller of your Personal Information collected and processed for the purposes described in this Privacy Statement.

WHAT INFORMATION DO WE COLLECT ABOUT YOU?

The information we receive, and how we use it, depends on what you do when visiting our website or using and/or subscribing to our services such as sharing of your story and/or project on our website, participating to the annual Virtual Conference, contacting us, or subscribing to our marketing emailing list. We collect and use non-Personal Information (information that does not identify you personally) differently to your Personal Information.

Personal Information is information that can specifically identify you.

When you visit our website

When visiting our website, we only collect strictly necessary personal information from you. This may include aggregated data that enables the Foundation to measure website performance.

You have the option to contact us via our Contact Us form. By visiting our website and potentially contacting us, we may collect Personal Information such as your:

  • first and last name
  • e-mail address;
  • your country location;
  • date of birth or age;interests and qualifications;
  • IP (Internet Protocol) address when such address is associated with a specific user;
  • your personal interests for potential (future) participation to in Foundation programs.
  • other information you choose to submit via that form.

when you Share your story / project

You have the option to share your story and/or passion project to represent people living with chronic conditions who want to create change in the world by giving back as part of a Foundation initiative called Life. Amplified. Inspired by Earl Bakken (“Program”).

Some Personal Information is typically collected when you choose to share your story and/or passion project with us, with the possibility to publish this story/project on our website. We will Process your Personal Information, as strictly relevant to this purpose, with the aim of representing people living with a chronic condition who give back.

For the purpose of reviewing your story/passion project to determine whether it aligns with the program objectives and can be eligible to be published on the Life. Amplified. Inspired by Earl Bakken. Foundation website, the Foundation may process the following type of Personal Information about you:

  • Contact details, such as your email address, name and surname;
  • Your country location;
  • Your health data, such as your medical condition;
  • Your status as a patient, employee or health care provider;
  • Your personal interests for potential (future) participation to the Life. Amplified. Inspired by Earl Bakken program;
  • The content shared through your story representing a person living with a chronic condition who gives back;
  • The content shared through your project describing the charitable activities a person living with a chronic condition does to improve the life of others.

For the purpose of sharing your story/passion project on the Life. Amplified. Inspired by Earl Bakken. website managed by the Foundation, the following types of Personal Information may be processed about you:

  • Contact details, such as your email address, name and surname;
  • Your video and/or image, audio that may be recorded to be used for publishing your story/passion project on the Foundation website;
  • Your health data, such as your medical condition, type of device you have (if any);
  • The content shared through your story representing a person living with a chronic condition who gives back;
  • The content shared through your Project representing a person living with a chronic condition who gives back and their charitable activities.

How do we collect your personal information?

We collect Personal Information about our users in two ways:

  1. when you enter Personal Information on certain pages of the website. For example, you may fill out a registration form for a particular service, participate in a survey, or complete a contact form in order to Share Your Story and/or Share your Project.
  2. using automated means, specifically through cookies. Cookies are small text files that are placed on your computer by websites that you visit. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the website. For what purposes DOES THE Foundation USE PERSONAL INFORMATION?

We may use the information that you have shared with us through this website and relevant services (other than sensitive information, which is discussed separately below) for the following purposes:

  • to respond to your requests
  • to provide the services or information you request
  • to allow you to register for our offered services (e.g. the Virtual Conference, Story Sharing, Sharing your Project)
  • to manage our relationship with you and facilitate any necessary follow up (e.g. by storing relevant information and preferences for a reasonable amount of time)
  • to enter into, or perform a contract with you (e.g. in case you wish to Share a Story or Project with us to publish this on our website and participate in an interview with us in written and/or video format),
  • to contact you with information that might be of interest to you – see further the Marketing and Education section below
  • In other ways to which you consent (e.g. using your image or audio or video footage for educational, promotional, or other legitimate business purposes to which you specifically consent);
  • to communicate with you regarding your interest in helping you edit your Share Your Story or Share your Project.

Foundation may also use your Personal Information to the extent necessary to achieve the following legitimate interests, so long as compatible with your rights and expectations of privacy:

  • for analytical purposes in order to research, develop and improve programs, products, services and content
  • to anonymize your information by removing any personal identifiers (your name, e-mail address, etc.) so that it may be used for other purposes. In this case, the anonymized information would no longer identify you and may be treated like other non-personal information. For more details please see the relevant section below.
  • to enforce this Privacy Statement and other rules about your use of this website
  • to protect our rights or property

Foundation also has legal grounds to use your Personal Information:

  • as necessary to protect someone's health, safety or welfare; and
  • in order to comply with a law or regulation, court order or other legal process

We may also process your Personal Information for the following operational purposes:

  • To track and manage compliance approvals and violations;
  • For activities to monitor and maintain the quality or safety of our products and services
  • To conduct audits and perform troubleshooting activities of our websites, products, and services
  • To detect and protect against security incidents and deceptive, malicious, or fraudulent activity
  • To ensure our website, products, apps, and services function as intended, including debugging and repairing
  • To comply with a law or regulation, court order or other legal process
  • Comply with laws including those regarding transparency, data subject requests and the management of training on the safe and effective use of our products

WHAT IS SENSITIVE INFORMATION?

Some types of Personal Information are sensitive information. Sensitive information m Personal Information revealing or relating to your health (such as your device serial number, or the date of an implant), genetic or biometric data, your racial or ethnic origin, religious or philosophical beliefs, sex life or sexual orientation, political opinions or trade union membership. 

WILL THE FOUNDATION TREAT SENSITIVE INFORMATION DIFFERENTLY TO OTHER PERSONAL INFORMATION?

Foundation will only collect and process your sensitive information:

  • in ways for which you have given your explicit consent
  • to protect the vital interests of you or another person, in cases where your explicit consent cannot be given or reasonably requested
  • according to applicable laws which include suitable and specific measures to safeguard your fundamental rights and interests
  • to establish, exercise, or defend a legal claim

For example:

  • We may collect sensitive information directly from you, when you voluntarily provide it to us for a particular purpose (e.g. when you contact us with a question or suggestion about our products and services, when you Share Your Story or Project, or register for our annual Virtual Conference);
  • We may also collect sensitive information about patients through healthcare professionals who we work with to provide therapy or technical support for our products or services to you.

NON-PERSONAL INFORMATION

Non-personal information is information that cannot identify you or be tied to you in any way. Therefore, the non-personal information that we collect through this website does not identify you as an individual person, and will not be linked to you. It may include information such as the following:

  • the type of web browser software you use (for example, Internet Explorer)
  • the name of the domain from which you access the Internet
  • the Internet address of the website from which you linked directly to our website
  • the date and time you access our website
  • which pages you have visited on our website 
  • the geographic location of the server you use to access our website

  • Personal Information that has been made non-personal or anonymized (i.e., information that no longer reflects or references an individually identifiable user)

If you visit our website to read or download information, such as information about a Foundation program, we may collect certain non-personal information about you from your computer. This information is collected from your computer's web browser.

If you only read or download information on our website, we do not collect or learn your name, e-mail address, home address, or other Personal Information about you.

WHAT DOES THE FOUNDATION DO WITH NON-PERSONAL INFORMATION?

We are always looking for ways to better serve you and improve our products, services and website experience. We will use non-personal information from you to make this website more useful to visitors. We may also use non-personal information for other business purposes. For example, we may use non-personal information or aggregate non-personal information to:

  • create reports for internal use to develop programs, products, services or content
  • adapt or improve the information or services provided
  • sell information to third parties, or share with third parties not acting under contract for the Foundation

If at any time you decide not to receive any educational, commercial or promotional information related to our products and services or regarding the products or services of our affiliates or service providers, you can unsubscribe by clicking on the unsubscribe button available in our email communication with you.

Please note that if you opt not to receive promotional messages from us, we may still continue to send you relevant information for other lawful purposes, such as to administer any account you may have with us, to respond to your requests, to execute agreements with you, or to provide you with information that Foundation is required by law to provide, e.g. regarding product recalls.

SURVEYS

From time to time we may invite you to participate in a survey to determine satisfaction levels, identify areas of potential improvement or to carry out market research. We may send you a specific invite to participate in such a survey on the basis of our legitimate interests in conducting the survey, or on the basis of your prior “opt-in” consent to receive such communications, in accordance with applicable laws. You may opt-out of receiving any such future communications in the manner detailed in the section above.

The Personal Information that is collected for the purpose of the survey may include your email address, phone number, survey results, and any free-text message you may have written in the survey.

We process your Personal Information as part of the survey for carefully considered and specific business purposes which are in our legitimate interests and which we believe also often benefit you, based on our assessment that our legitimate interests do not override your freedom and data protection rights.

The business purpose of collecting your data is to reply to survey feedback you may have provided, specifically:

  • Should you have indicated an issue which we need to take action to resolve
  • In order to gain further insight to the experience you have described
  • To inform you of any action we might take internally to resolve your issue or enhance your experience

DOES THE Foundation EVER SHARE PERSONAL INFORMATION WITH THIRD PARTIES?

Foundation will not share your Personal Information collected from this website with a third-party except as described in this Privacy Statement.

We may share Personal Information with any member of our corporate group, including parent companies, subsidiaries, and affiliates, and other companies in which we have an ownership or economic interest for purposes that are consistent with those identified in our Privacy Statement and this Notice. Foundation may share or transfer Personal Information as part of a transaction, such as a merger or acquisition, under which a third party acquires or full or partial ownership of a Foundation affiliate, subsidiary, or business. In the ordinary course of business, we will share some Personal Information with companies, such as service providers, that we hire to perform services or functions on our behalf.

For example, we may:

  • use a third party service provider to administer certain newsletter or informational mailings that you have signed up for, and provide access to your email address for this purpose.
  • Use a third-party public relations firm to perform the interviews and potentially shoot the videos with you when you would like to share your story or project on our website.
  • use a third-party application or platform to allow us to manage and keep track of our communications with you.
  • use our company affiliates to provide services relating to your Personal Information e.g. we may store your information on a secure server based at our affiliate’s site in Europe or the United States.   • use a third-party application or platform to conduct surveys, which can include storage of the survey feedback.

In all cases we will not share more information than is necessary, and we will not authorize any third parties to keep, disclose or use your information except to provide the requested services in line with the purposes set out above.

Please note that subject to applicable laws, we may disclose your Personal Information if we believe we are required to do so to comply with any law, regulation, court order, legal or government request.

In addition, we may use and disclose your Personal Information to third parties if necessary to:

  • enforce this Privacy Statement and the other rules about your use of this website
  • protect our rights or property
  • protect someone's health, safety or welfare

In addition, please keep in mind that certain areas of our website may be interactive in nature, and allow you to post information that other users can see. If you do not wish to have information viewed publicly, please do not use those sections of the website.

DO WE TRANSFER PERSONAL INFORMATION TO OTHER COUNTRIES?

In certain cases Foundation may transmit Personal Information collected on this website to our affiliates or third party service providers in other countries, but only in furtherance of the purposes set out in this Privacy Statement. When European Personal Information is transferred outside the European Economic Area (EEA), UK or Switzerland, we use approved legal mechanisms, which may include standard data protection clauses (EU Model Clauses), to meet data protection laws and requirements. HOW LONG WILL WE KEEP YOUR PERSONAL INFORMATION FOR?

We will only keep your Personal Information for so long as necessary to fulfill the purposes for which we are allowed to use them, as set out in this Privacy Statement. For example, if you tell us that you no longer wish to receive a newsletter from us, we will immediately delete your email address from our mailing list. In case you participate in a program via our website we will delete the Personal Information provided as part of that program within a reasonable time after its completion (e.g. six months after completion will normally be considered reasonable unless we have lawful grounds to retain some of the information for longer (e.g. if necessary for validation or to comply with recordkeeping obligations)).

ARE THERE SPECIAL RULES ABOUT CHILDREN'S PRIVACY?

We care about protecting the online privacy of children. We will not intentionally collect any Personal Information (such as a child's name or e-mail address) from children under the age of 16 without the consent of someone holding parental responsibility. WHAT ABOUT WEBSITE SECURITY?

Security is very important to us. We also understand that security is important to you. We use industry standard measures to protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However no website or email transmission is 100% secure and we encourage you to therefore take special care in deciding what information you send or request via email, and take appropriate precautions such as keeping any usernames and passwords you use confidential.

Foundation collects information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California consumer or household (“personal information”). We may have collected the following categories of personal information from consumers through our websites, apps, services, devices, or other services within the twelve (12) months preceding the effective date of this Privacy Statement:

  • certain personal or financial information covered under certain sector-specific privacy laws.

  • Directly from consumers’ interactions with us, including with our devices, applications, websites, services, and representatives
  • Publicly available sources
  • Customers, including health care providers and insurance providers
  • Organizations with whom we partner to provide services to consumers

Use or Disclosure of Personal Information

In the past 12 months, we have used or disclosed the personal information we collect for our operational purposes and for one or more of the following business purposes:

  • To provide programs and services to consumers
  • For sharing the stories of patients as voluntarily submitted to us, assessing volunteered stories for possible publication, and producing media related to sharing these stories
  • To respond to consumer requests
  • To improve and personalize consumer access to and experience on our website, for example, by telling consumers about new features, products, or services that may be of interest to them
  • To develop records, including records of consumers’ personal information
  • To contact consumers with information that might be of interest to them, including, to the extent permitted by law, information about programs or offerings of ours and of others

How We Share Personal Information

Foundation will not share consumers’ personal information with an unrelated third party without permission, except as described below. Foundation may share personal information with the Foundation’s corporate group, including parent companies, subsidiaries, and affiliates, and other companies in which we have an ownership or economic interest for purposes that are consistent with those identified in our Privacy Statement and this Notice. Foundation may share or transfer personal information as part of a transaction, such as a merger or acquisition, under which a third party acquires or full or partial ownership of a Foundation affiliate, subsidiary, or business. In the ordinary course of business, we will share some personal information with companies, such as service providers, that we hire to perform services or functions on our behalf. Some companies performing services on our behalf may collect personal information for us. In all cases in which we share consumers’ personal information with a third party vendor, we require them to keep personal information confidential, and will only allow them to keep, disclose, or use consumers’ information to provide the services we asked them to provide. We may be required to release consumers’ personal information in response to a court order, subpoena, search warrant, law, or regulation. We may cooperate with law enforcement authorities in investigating and prosecuting users who violate our rules or engage in behavior which is harmful to other users or illegal. In addition, we may keep, disclose, and use consumers’ personal information in order to comply with governmental guidance, directions, regulations, and laws.

Categories of Personal Information We Sell or Share

We do not sell or Share for remarketing purposes personal information of California consumers.

This does not include disclosures that are not a “sale” under the CCPA, including when:

  • consumers instruct us to disclose their personal information,
  • a consumer instructs us to interact with a third party that does not sell that information,
  • we use or share consumers’ personal information pursuant to a written contract with a service provider that is necessary to perform a business purpose, where our contract prevents the provider from using, keeping, or disclosing consumers’ personal information for any purpose other than the reason supplied in the contract, or
  • consumers’ personal information is transferred as part of a transaction in which the third party assumes control of all or part of our business.

Personal Information on Minors

We do not sell personal information of California consumers, including minors.

Rights under California Law

  1. Right to Access. If you are a California consumer, you have the right to ask us to send you the following information up to two times in a twelve-month period:
    • The categories of personal data we have collected about you.
    • The categories of sources from which we collected the personal data.
    • Our business or commercial purpose for collecting personal data.
    • The categories of third parties with whom we share personal data.
    • What categories of personal data we disclose about you for business purposes.
    • What categories of personal data we sell or exchange for consideration about you.
    • The specific pieces of personal information we have collected about you.
  2. Right to Delete. If you are a California consumer, you have the right to ask us to delete the personal data about you we have collected. We may deny the request if the information is necessary to:
    • complete a transaction, including providing a requested or reasonably anticipated good or service, or fulfill a contract between the consumer and Foundation;
    • detect and protect against security incidents, malicious, deceptive, fraudulent, or illegal activity, or take against those responsible for such activity;
    • debug to identify and repair errors impairing intended functionality;
    • exercise free speech or another right provided for by law;
    • comply with the California Electronic Communications Privacy Act;
    • engage in research in the public interest adhering to applicable ethics and privacy laws where the consumer has provided informed consent;
    • enable solely internal uses reasonably aligned with the consumer’s expectations based on the consumer’s relationship with Foundation;
    • comply with a legal obligation; or
    • otherwise use the information internally in a lawful manner compatible with the context in which the consumer provided the information.
  3. Right to Opt-out. If a business sells personal information to third parties, California consumers have the right, at any time, to opt out of the sale or disclosure of their personal information to third parties. Foundation does not sell personal information to third parties.

Right to non-discrimination. The CCPA grants California consumers the right not to be discriminated against for exercising your privacy rights. If you exercise your privacy rights, we will not discriminate against you, for example, by denying you access to our online services or charging you different rates or prices for the same online services, unless that difference is reasonably related to the value provided by your data.

Submitting a Request or Inquiry

If you are a California resident and you want to submit a request or inquiry to us regarding your California rights, you or your authorized agent can contact us at rs.medtronicfoundation@medtronic.com or call us at 1-866-639-6907. You do not have to create an account with us to submit a request.

Your request will be confirmed within ten days of receipt and we will respond within 45 days. If we need more than 45 days, we will notify you that your request is being delayed.

We can only respond to your request if it is verifiable. This means we are obligated to take reasonable steps to verify your identity or your authorized agent’s authority and your right to access the information you request. In the process of verifying your request, we may contact you to ask for additional information that will help us do so, including government-issued IDs containing your name and address, utility bills containing that same information, and/or unique identifiers like usernames. We will only use that additional information in the verification process, and not for any other purpose. Once we have received and verified the requested information from you, we will contact you with our response to your request, including any data, if applicable. If we do not hear from you or are unable to verify your identity for the request, we will contact you to inform you that we cannot process your request because we cannot verify your identity.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
